We are a buyer's agent business operating in New South Wales, Australia. This policy explains how we collect, hold, use, and disclose personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), including personal information collected:
when you engage us as a buyer's agent client;
when you visit our website or contact us; and
as required under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) ("AML/CTF Act"), as a regulated real estate business.
By providing personal information to us, you consent to its collection, use, and disclosure in accordance with this policy.
2. What personal information we collect
Depending on how you interact with us, we may collect:
General contact and enquiry information: name, email address, phone number, postal/property address, and details of your enquiry.
Client information (buyer's agent services): the above, plus property preferences, budget, financing status, and other details relevant to representing you in a property purchase.
Identity and due diligence information (AML/CTF Customer Due Diligence): as a real estate business regulated under the AML/CTF Act, when you engage us as a client, we are required to collect and verify:
full name, date of birth, and residential address;
government-issued identification documents (e.g. driver licence, passport);
information about the source of funds for a property purchase;
beneficial ownership information, where you are purchasing via a company, trust, or other structure; and
screening information relevant to sanctions and Politically Exposed Person (PEP) checks.
Website and technical information: IP address, browser type, pages visited, and similar data collected automatically via cookies or analytics tools when you visit our website (see Section 8).
We collect personal information directly from you wherever practicable, such as through our website forms, phone, email, or in person.
3. Why we collect, hold, use, and disclose personal information
We collect and use personal information for purposes including:
providing buyer's agent services to our clients;
complying with our legal obligations under the AML/CTF Act, including Customer Due Diligence, ongoing monitoring, and (where required by law) reporting to AUSTRAC;
responding to enquiries and communicating with you about our services;
marketing our services to you, where you have consented (you can opt out at any time — see Section 6);
improving our website and services; and
meeting other legal, regulatory, or reporting obligations.
We do not use AML/CTF Customer Due Diligence information for any purpose other than complying with our legal obligations, and we do not use it for marketing.
4. Disclosure of personal information
We may disclose personal information to:
AUSTRAC and other regulators, where required or authorised by law (including suspicious matter reports, which we are legally prohibited from disclosing to the individual concerned);
third parties involved in a property transaction you engage us for, such as selling agents, conveyancers/solicitors, lenders, and settlement agents, as reasonably necessary to carry out our services;
our service providers, such as website hosting, email/CRM platforms, and identity verification providers, who are contractually required to protect your information and only use it for the purposes we specify;
our professional advisers, such as our lawyers or accountants, where necessary; and
any other party, where required or authorised by law, or with your consent.
We do not sell personal information to third parties.
We do not disclose personal information to overseas recipients
5. Marketing and opting out
Where you have consented to receive marketing communications from us, you may opt out at any time by:
clicking "unsubscribe" in any marketing email; or
contacting us using the details in Section 10.
We will not use AML/CTF-related information, or information collected solely for the purpose of administering a promotion, for marketing unless you separately consent.
6. Data security and retention
We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification, or disclosure, including secure servers, access controls, staff training.
We retain personal information for as long as reasonably necessary for the purposes described in this policy, and as required by law. In particular:
AML/CTF records (identity verification, due diligence, and transaction records) are retained for a minimum of seven (7) years, as required under the AML/CTF Act.
Other personal information is retained only as long as necessary, after which it is securely destroyed or de-identified, unless we are required to retain it by law.
